Steve's position and anaysis certainly seem reasonable and conservative in the sense that it does not go the full distance to say that someone going to another state just to return and claim recognition would not be covered. But I think, unfortunately, that even with Obama appointments to the Supreme Court, it will be a considerable amount of time before Steve's argument becomes a bedrock of federal precedent.
